Transfers of Equity

A transfer of equity is the process of adding or removing someone from the title to a property.  This can happen for many reasons including marriage or separation.

We can help explain how the process will work for your particular situation and draft the documents required for the transfer of ownership to suit your circumstances.   Often there is a lot to consider for these kind of situations and they can be more complex than first expected.

We will:

  • Provide you with a fixed fee quotation  - so that you can make sure you have taken into account all the costs you will incur and provide your quote by telephone, post or email (click here to contact us for a quote)
  • Give you updates using your preferred method of contact at every stage of the transaction
  • Provide you with a dedicated conveyancer so that you aren’t speaking to a team of different people but have someone that will be with you all the way to completion.
  • Listen to your particular circumstances to understand what you are trying to achieve with your transfer.
  • Explain any legal issues and give you advice and options about how we resolve those issues in your best interests.
  • Alert you to any stamp duty land tax requirements of HMRC arising from the Transfer, although we are not tax advisors so we may need to direct you to obtain specialist advice from other sources where necessary.
  • Assist with any mortgages already on the property or needed to allow the transfer to proceed.

What we will need from you:

  • Your identity documents –  we have an obligation as part of the anti-money laundering legislation to check the identity of all clients instructing us in property transactions.   We use either an online company to assist securely with our checks or you can attend one of our offices in person with your documents for us to verify.
  • An idea of your timescale for the transfer, we do try to work with your expectations for the timing of the transaction but it is important to bear in mind that we will be reliant on the mortgage offer and in some cases the mortgage lenders solicitor. 
  • Documents relating to the reason for the transfer such any court order in place.

Documents relating to the property such as any planning permission, building regulations certificates or installation certificates.
