When Money Goes Missing After a Break-Up Image

Our family law team helped a client when their marriage had unfortunately broken down. The couple had lived together before and during the marriage. After separation, they sold the family home. Without warning or agreement, the wife removed all of the money from the sale of the property from their joint bank account and disappeared. This left our client with no access to money and serious worries about finances and finding somewhere to live.

Tracking Them Down

We tried many times to contact the wife, but she did not respond and could not be found. Our legal team therefore carried out thorough searches, including using specialist tracing services. We eventually traced an address, which allowed us to start divorce proceedings and formally notify her.

Even then, the wife made things difficult. We discovered she had already used the money from the house sale to buy another property, trying to keep it out of reach.

At the same time, she made no real effort to resolve the issue of how the pensions should be dealt with, as both parties had built up significant pension savings during the relationship.

Taking the Case to Court

Because an agreement couldn’t be reached and wife did not cooperate, we had to take the matter to court.

With the help of a barrister, we built a strong case focusing on:

  • The fact that shared money had been taken and used unfairly
  • Lack of evidence to support any claims that the wife couldn’t work or needed more of the money from the property
  • Her behaviour and how it affected the available assets
  • Making sure the final outcome was fair after a long relationship

The Outcome

With the Court’s help, we achieved a fair result for our client, including:

  • Recovering and fairly dividing the money that had been taken
  • Splitting pension assets properly
  • Ensuring our client had enough financial security to find a new home and move forward safely

This outcome made sure our client’s contributions were recognised and corrected the unfair advantage the wife tried to take.
